Acceptance of the general terms and conditions

The general conditions of use and sale described below (hereinafter referred to as “General Conditions”) govern the contractual relations between any buyer on the website TIENDA.CESARNIETO.COM (hereinafter referred to as “Customer”) and the company CESAR NIETO GROUP S.L. (with Tax ID: B37417714), owner of the website TIENDA.CESARNIETO.COM (hereinafter referred to as “WEB”).

These General Terms and Conditions are the only ones applicable and replace any other general terms and conditions, except in case of prior, express and written cancellation. Occasionally, some items may be modified, so it is advisable that these are read and accepted with each purchase. These amendments shall be effective as of their publication on the Internet and may not be applied to previously concluded contracts.

Each purchase on the WEB is governed by the general conditions applicable on the date of the order. In order to place an order, the general terms and conditions of sale must be accepted without reservation after having read them. Notwithstanding the fact that the company requires the express acceptance of these general conditions during the purchase process, the fact of completing all the necessary steps to place an order implies the acceptance of these general conditions. Should a condition be missing, it shall be deemed to be governed by the customs and practices in force in the distance selling sector in accordance with the rules of the professional code of the Distance Selling Association.

CESAR NIETO GROUP S.L., reserves the right to reject any of the orders that may be created, with the immediate refund of the amount thereof.

Product information

Both the literature in the descriptions and the illustrative photographs of the products are merely informative, not contractual. Only the declared weight and content are contractual.

Information on weights

It is impossible to produce pork products of an exact weight. The weights offered for each product are approximate, guaranteeing only that the actual weight will be between the minimum and maximum indicated with a possible margin of error:

Margin of error for hams + – 250 grams,

Margin of error for pallets of + – 250 grams,

Margin of error for loins and sausages of + – 200 grams.

Margin of error for bags of fresh meats +- 100 grams

The published weights are the statistical central weights of these ranges.

Conservation

All products are marked with a best-before date recommendation: the point at which quality begins to decline significantly, although the product is still edible. The WEB is not responsible for the consequences of its consumption after this date, which will be 15 days for refrigerated products and 1 year for frozen and cured products.

Billing

All orders placed on this WEB will be sent together with their corresponding delivery note. The corresponding invoice will be sent at the time of payment, confirmed via e-mail, and a copy can be requested via e-mail at any time after confirming your purchase. Please note that the data provided at the time of purchase will be those detailed in the invoice, and no changes can be made to them after the invoice is issued. In case of companies, it is important to put in their boxes the VAT number as well as the address and the correct company name. For natural persons it is essential to fill in the DNI (National Identity Card).

The personal data to be provided by the Customer are indispensable for the shipment of orders and the drafting of invoices. In particular, it is understood that access to the purchase is only allowed to persons of legal age, and this will be confirmed by the Customer when entering the date of birth along with their data. The absence or lack of veracity of these data will lead to an automatic cancellation of the orders.

Right of withdrawal

In accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, the Customer has the right to withdraw from the contract without justification, right to be exercised within a maximum period of 72 hours from the date of delivery. However, given the nature of the products, the exercise of the right of withdrawal will be conditional on the product being returned to the WEB with the packaging and all seals in perfect condition. In case of exercise of the right of withdrawal the Customer will be refunded the full price of the product being the cost of returning the product at the Customer’s expense. To exercise the right of withdrawal, the Customer must contact the WEB through the following email: info@cesarnieto.com, where they will indicate the steps to follow.

Warranty

If, after delivery of the product, the Customer considers that the product in question does not meet the quality conditions necessary for its consumption, he/she must send us an e-mail describing his/her complaint and attaching a photo of the claimed product no later than 72 hours after receipt.

Regarding the possible problems in the product produced by the handling of the transport agency, they will have to be put in knowledge of the transporter and the company at the same moment of the reception of the order, proceeding to the return of the same instant.

Within five days you will receive an answer to your complaint accepting it totally or partially with the appropriate justification, and you will be offered from the replacement of the merchandise with shipping costs at our expense to a repair system or even a full refund of your money in the same account or card you used for payment. In the latter case, the goods must be returned. The refund of the amount will take place once the shipment has been received and its content verified, all within 5 days. Due to the food characteristics of the product, returns will not be accepted unless they have been preceded by a warning e-mail and confirmed by our customer service department (customer service hours on working days 9:00-14:00/ 15:30-18:30).
